Terms and Conditons

Please ensure you read and understand the following terms and conditions pertinent to your accommodation rental. If you have any questions, please do not hesitate to contact us for clarification before you complete your reservation.

Payment

Your reservation will be confirmed upon payment of the $300 down payment, this will confirm that the home will be available for you during the dates specified at the rate offered upon booking. Tax is not included in nightly rates. Full payment is due 30 days prior to the date of arrival and will be charged to your credit card at that time unless other payment arrangements have been made. Only upon receipt of full payment will the property check-in and access information be provided. If full payment is not received in this time, the reservation will be cancelled and the deposit paid will be forfeited by the guest. We require that a credit card be kept on file in order to book a reservation. The credit card will be used in the event that damage is found to the property upon guest departure (including excess cleaning fees). We encourage all guests to purchase travel insurance to protect them from unexpected travel changes, accidents and/or damages incurred.

There is a one-time departure cleaning fee assessed to all reservations. The home will be clean upon your arrival but no additional cleanings are included in the quoted rate. You may purchase mid-stay cleans at an additional cost.

Checking in/out:

Check-in Time: 4:00pm

Check-out Time: 10:00am

Early check-in and late check-outs may be requested; they are based on availability and may incur additional fees. A registration form will be provided at check-in. The person who signs the registration form certifies that he or she is authorized to agree to the Terms and Conditions on behalf of all persons included on the registration form, including those substituted or added at a later date. The signatory must be a member of the party occupying the property and must be 21 years or over. Bookings cannot be accepted from parties of young people under 21 years of age.

  • All properties are non-smoking and absolutely no pets are allowed.
  • Our villa is situated in a quiet residential area consisting of approximately 50/50 rental homes/US families. It is a condition of the rental that you should be considerate in your behaviour and keep noise levels to a reasonable level so as not to disturb our neighbours.
  • By state law, occupancy may not exceed what is posted for each home.

LOST, STOLEN OR ABANDONED ARTICLES. Owner shall have no responsibility for lost, stolen or abandoned items.

Reservation Cancellations & Changes

Cancellations must be received in writing and reservations cannot be cancelled within 30 days of arrival. The following refund policy is in place:

  • Cancellations 60+ days before arrival- full down payment will be refunded
  • Cancellations 60+ days before arrival- full down payment will be refunded
  • Cancellations 59-31 days before arrival – down payment is forfeited
  • Cancellations 30 days or less before arrival – full payment is forfeited

Modifications to original reservation may be requested and are based on availability. Please note that rate quoted is guaranteed only as per your original request. Changes to reservation may alter the price of the booking. There are no refunds for early departures, delayed arrivals, inclement weather or reduction in the number of nights reserved.

In the unlikely event that circumstances beyond the Owner’s control necessitate the cancellation of the rental arrangement, the Owner reserves the right to cancel any bookings at any time and will only be liable to refund monies already paid by the Guest. Furthermore, the Owner cannot guarantee that all the facilities described in their brochure or website will be available.

The Guest agrees to pay the full cost of any breakages, losses or damage to the property (the Owner’s Management Company will be sole arbitrators on cause of damage or loss)

  1. To take good care of the property and leave it in a clean and tidy condition at the end of the holiday.
  2. To report any damage or loss immediately it is discovered to CozyKey Vacation Rentals. Repair and maintenance problems must be brought to Manager's attention within 48 hours of occupancy or occurrence, or Guest will be held liable for all such damages or repairs.
  3. Guest must leave the Unit in a clean condition to include the following: (a) all trash removed from the Unit, (b) all dirty dishes put into dishwasher and started, (c) refrigerator left clean and free of perishable food, (d) dirty linens/towels collected into a pile in the laundry room, (e) entry door locked and windows closed and locked, and (f) all breakage reported to Owner. Failure to comply will give Owner the right to deduct appropriate sums from the security deposit.
  4. To permit the Owner or their Agents reasonable access to the property to carry out any maintenance if necessary.
  5. Not to sublet or share the property except with persons nominated on the registration form.

Indemnification

No liability is accepted by the Owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner.

The Owner does not accept any liability for injury, damage or loss caused by any reason or for any claim made as a result of this booking and/or the subsequent holiday. The Guest is responsible for taking out adequate insurance policy(ies) to cover all risks. This waiver is also applicable to people visiting the property as guests of the Guest(s).

The Owner does not accept any liability for injury, damage or loss caused, or for any such claim by a third party as a consequence of actions by the Guest(s) and other people occupying the property during the term of the rental.

Hurricane Policy

CozyKey Vacation Rentals does not offer refunds or reschedule trips due to hurricane activity. If you are concerned about possible interruption, cancellation or delayed travel due to tropical occurrences, you are strongly encouraged to purchase travel insurance.

Pool & Spa

Please use the pool and spa on premises responsibly and follow all posted pool rules. Children must always be supervised and the pool should not be used while intoxicated. You use the pool and all home facilities at your own risk. The pool is cleaned and chemically balanced every week for your safety and comfort; however on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay, it will be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.

Parking

Each rental community has different parking rules and restrictions including but not limited to restrictions on commercial, oversized vehicles, boats, trailers and others. The number of available parking spots per rental unit is limited. Please contact us for specific rules pertaining to parking rules in your rental community.

Complaints: We sincerely hope you do not have any! ...But in the unlikely event that you wish to register a complaint during your holiday, contact the property management company immediately. Unfortunately we are not always able to control the components of your rented accommodation and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability

Short-Term Rental: It is expressly understood and agreed that this is a short-term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long term residential tenancy agreement. This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Guest and no rights to renewal or for recurring usage. This Agreement is also neither a Time-Share sale or a Plan of Time-Share Development, nor a Vacation Club.

Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check in and/or will be subject to immediate eviction with the forfeiture of all amounts paid.

Succession, Assignment: This Agreement is binding on, and the benefits inure to, the heirs and personal representatives of the parties. However, neither this Agreement nor any rights hereunder may be assigned (in whole or in part) by Guest.

Cause for Eviction: The Guest and all parties with the Guest will be subject to immediate eviction from the Property if the Guest or parties of the Guest violate any terms of this Agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or other. In the event of eviction from the Property, the Guest shall forfeit all amounts paid and there will be no refund of money.

Attorney’s Fees and Costs: If Manager employs the services of an attorney to enforce any conditions of this Agreement, to collect any amounts due, the eviction of the Guest, or because Guest takes any action to recover deposits not due, Guest shall be liable to Manager for reasonable attorney's fees and costs incurred by Manager.

General Terms: This Agreement is made in, and shall be governed solely by the laws of, the State of Florida and Chapter 509, Florida Statutes. Venue for enforcement shall be the county where the rental house booked is located. If any section, clause, paragraph or term of this Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect.
